§ 1 Scope and definitions
(1) These terms apply to all contracts for the delivery of 3D-printed products and for 3D design services between PrintableArtForge, owner Joel Kilb (the "Seller") and the customer (the "Customer").
(2) A consumer is any natural person entering into the contract for purposes largely outside their trade, business or profession (§ 13 BGB). An entrepreneur acts in the exercise of their trade, business or profession (§ 14 BGB).
(3) Deviating terms of the Customer do not become part of the contract unless the Seller expressly agrees to them in text form.
§ 2 Conclusion of contract
(1) The presentation of products in the online shop is not a binding offer but an invitation to order.
(2) By clicking the "Buy now — payment obligation" button, the Customer makes a binding offer to purchase the goods in the cart.
(3) The Seller confirms receipt of the order by email without delay. This acknowledgement of receipt is not yet an acceptance of the offer. The contract is concluded once the Seller expressly declares acceptance or dispatches the goods; for personalised work at the latest when the 3D preview is sent for approval. Where a payment method with immediate payment is used (PayPal, Apple Pay, Google Pay, Shop Pay), the contract is concluded when the Customer instructs the payment.
(4) The Seller stores the contract text and sends it to the Customer by email together with these terms and the withdrawal instructions. Past orders are additionally visible in the customer account.
(5) The technical steps leading to the contract, the entry of order data and the correction of input errors follow from the ordering process: before you submit, a summary page shows all your entries; they can be corrected there using the usual browser and mouse functions and the edit buttons.
(6) The contract language is German. English versions are provided for clarity; the German text prevails.
§ 3 Subject matter
(1) Our range covers personalised 3D designs from photographs, hand-painted statues and figurines in UV resin, and other 3D-printed products.
(2) Statues are produced by 3D printing in UV resin and then hand-painted with acrylic paint.
(3) Agreed condition of hand-painted pieces
Hand-painted pieces are individual items. Slight variations in painting, colour intensity and brushwork, as well as production-related tolerances in surface and shade, are an expressly agreed characteristic and not a defect, as long as function and overall impression are not materially impaired. For consumers this is additionally shown and confirmed separately before the order is placed (§ 476(1) sentence 2 BGB).
§ 4 Personalised work
(1) The Customer provides suitable photographs and all information needed for the design.
(2) The Seller creates an individual 3D design from them. The Customer receives a digital preview for approval before production.
(3) Production starts only after approval. Until then the Customer may cancel free of charge. Changes requested after approval cannot be taken into account.
(4) The Customer warrants that they hold all necessary rights to the photographs supplied and that their use does not infringe third-party rights, in particular copyright and personality rights. The Customer indemnifies the Seller against third-party claims arising from an infringement of those rights.
(5) Personalised work is excluded from the right of withdrawal; see § 8 and the withdrawal instructions.
§ 5 Prices and payment
(1) All prices are final prices. The Seller's turnover is exempt from VAT under § 19 UStG (small business rule); VAT is therefore neither charged nor shown.
(2) Shipping costs are additional and are shown separately before the order is completed.
(3) The payment methods offered in the shop apply. Where payment on invoice is used, the price is due in full within 14 days of the invoice date.
(4) For personalised work with an order value from €250, a deposit of 50 % is payable before production starts; the balance is due before dispatch. The Customer is informed of this before placing the order.
(5) If the Customer is in default of payment, the statutory rules apply.
§ 6 Delivery
(1) Delivery is made to the address given by the Customer. We currently ship within Germany only.
(2) Delivery takes 2 to 7 working days (1 to 3 working days processing, 1 to 4 working days transit, Monday to Friday). With advance payment the period starts on the day after the payment instruction, otherwise on the day after the contract is concluded.
(3) For personalised work the delivery time is longer for production reasons; the expected duration is stated on the product page and starts when the preview is approved.
(4) We ship with DHL. Shipping costs are a flat €5.99 per order; orders of €50 or more ship free. Details under Shipping and delivery.
§ 7 Retention of title
The goods remain the property of the Seller until payment has been made in full.
§ 8 Right of withdrawal
(1) Consumers have the statutory right of withdrawal. Details are set out in the withdrawal instructions.
(2) There is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer's personal needs (§ 312g(2) No. 1 BGB). This covers personalised 3D designs from photographs and custom work made to customer specification.
(3) Hand-painted statues and figurines from our standard range are not excluded — not even where you choose between offered finishes or sizes. They can be returned as usual.
§ 9 Liability for defects
(1) The statutory rules on defects apply. Claims for newly manufactured goods become time-barred two years after delivery.
(2) The variations described in § 3(3) are not a defect.
(3) For personalised designs from photographs, the result depends on the quality of the photographs supplied. The Seller points out clearly unsuitable source material before production.
§ 10 Care and safety
(1) UV resin products should not be exposed to permanent direct sunlight; this can cause discolouration.
(2) The statues are decorative objects, not toys. Keep them out of the reach of small children.
(3) Clean with a soft, dry cloth. Aggressive cleaning agents damage the paintwork.
§ 11 Liability
(1) The Seller is liable without limitation for intent and gross negligence, for injury to life, body or health, where a guarantee has been given, and under the German Product Liability Act.
(2) In cases of slight negligence the Seller is liable only for breach of a material contractual obligation — one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance the Customer may regularly rely. In such cases liability is limited to the foreseeable damage typical for this type of contract.
(3) Liability is otherwise excluded.
§ 12 Copyright in the designs
(1) The 3D designs, models and files created by the Seller remain the Seller's intellectual property. The Customer acquires ownership of the physical object delivered.
(2) Reproducing the designs, casting or copying the delivered objects, and passing on or exploiting the underlying files are not permitted.
(3) The Customer's right to resell or give away the object purchased is unaffected.
§ 13 Data protection
Personal data is processed in accordance with our privacy policy.
§ 14 Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
§ 15 Final provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
(2) If the Customer is a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship is the Seller's registered office.
(3) Should a provision be invalid, the validity of the remaining provisions is unaffected.
