TERMS AND CONDITIONS

§ 1 Scope

(1) These General Terms and Conditions (hereinafter “GTC”) apply to all contracts for the delivery of 3D printed products and 3D design services concluded between PrintableArtForge (hereinafter “Seller”) and the customer (hereinafter “Customer”).

(2) Differing conditions from the customer will not be recognized unless the seller expressly agrees to their validity in writing.

§ 2 Conclusion of contract

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order.

(2) By clicking the “Order with payment” button, the customer makes a binding offer to purchase the goods in the shopping cart.

(3) The seller confirms receipt of the order by email. This order confirmation represents acceptance of the offer. The contract is concluded upon receipt of this email.

§ 3 Product description and range

(1) Our range includes:
  • Personalized 3D designs based on photo templates
  • 3D printed hand-painted UV resin (resin) god statues
  • More 3D printed products
(2) The hand-painted god statues are made from high-quality UV resin (resin) using a 3D printing process and then hand-painted with acrylic paint in gold, silver, bronze or black.

(3) Since the hand-painted statues are handmade individual pieces, slight variations in the painting and coloring may occur. This is a feature of handcrafted production and does not represent a defect.

§ 4 Personalized products and 3D design based on photo templates

(1) For personalized 3D designs based on photo templates, the customer is obliged to provide suitable photos and all necessary information for the design.

(2) The seller creates an individual 3D design based on the photos provided. The customer receives a digital preview for approval before production.

(3) Production takes place after approval by the customer. Change requests after approval has been granted can no longer be taken into account.

(4) The customer assures that he has all necessary rights to the photos provided and that their use does not infringe any rights of third parties (in particular copyrights, personal rights). The customer releases the seller from all third-party claims resulting from the violation of these rights.

(5) Personalized products are excluded from the right of withdrawal (see § 8).

§ 5 Prices and payment conditions

(1) All prices include statutory VAT.

(2) In addition to the product prices, there are shipping costs, which are transparently displayed to the customer before completing the order.

(3) Payment is made using the payment methods offered in the shop.

§ 6 Delivery and shipping

(1) Delivery is made to the delivery address specified by the customer.

(2) Delivery times:
  • Germany: 2-5 working days after receipt of payment (for standard products)
  • International: 7-22 working days after receipt of payment (for standard products)
(3) For personalized products and hand-painted god statues, the delivery time is extended due to individual production. The estimated delivery time is stated in the product description.

(4) Shipping takes place with DHL. Shipping costs vary and can be viewed here.

(5) Hand-painted god statues are carefully packaged to avoid damage in transit.

§ 7 Retention of title

The delivered goods remain the property of the seller until full payment has been made.

§ 8 Right of withdrawal

(1) Consumers generally have a right of withdrawal in accordance with the statutory provisions.

(2) The right of withdrawal does not apply to contracts for the delivery of goods that are manufactured according to customer specifications or are clearly tailored to personal needs. This applies in particular to:
  • Personalized 3D designs based on photo templates
  • Custom-made 3D prints according to customer specifications
  • Hand-painted god statues (due to individual craftsmanship)
(3) The statutory cancellation period of 14 days applies to non-personalized standard products.

§ 9 Warranty

(1) The statutory warranty rights apply.

(2) For 3D printed products made of UV resin, material-related tolerances and slight variations in color and surface structure may occur. These do not constitute a defect as long as they do not significantly impair functionality and appearance.

(3) For hand-painted products, slight variations in the painting, color intensity and brushwork are characteristic of the handcrafted production and do not represent a defect. Each piece is unique.
(4) For personalized designs based on photos, the quality of the final product depends on the quality of the photos provided. The seller is not liable for any loss of quality resulting from inadequate photo templates.

§ 10 Care and safety instructions

(1) UV resin products should not be exposed to direct, long-term sunlight as this may cause discoloration.

(2) The hand-painted god statues are decorative objects and are not suitable as toys. They should be kept out of the reach of small children.

(3) We recommend a soft, dry cloth for cleaning. Aggressive cleaning agents can damage the painting.

§ 11 Liability

(1) The seller is liable without limitation for intent and gross negligence as well as in accordance with the Product Liability Act.

(2) In the event of slight negligence, the seller is only liable if essential contractual obligations (cardinal obligations) are breached. In this case, liability is limited to the foreseeable damage that is typical for the contract.

(3) Liability for personal injury remains unaffected.

§ 12 Copyright

(1) All 3D designs and god statue designs created by the seller remain the property of the seller. The customer exclusively acquires the right to private use of the physical product.

(2) Any reproduction, distribution or commercial use of the designs is not permitted without the express written consent of the seller.

§ 13 Data protection

The processing of personal data takes place in accordance with our data protection declaration.

§ 14 Online dispute resolution

Alternative dispute resolution in accordance with Article 14 Paragraph 1 ODR-VO and Section 36 VSBG:

§ 15 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If individual provisions of these General Terms and Conditions are ineffective, the effectiveness of the remaining provisions remains unaffected.
